Our Client was seeking a new house for their growing family and ideally wanted to be located in a popular area.
We helped them find this amazing property and to beat out multiple offers. Our Client was selected ahead of the other offers, due to the clean nature of the offer and their commitment to achieving a rapid close of escrow.
..but, as occasionally happens, the story did not end there. The house had a walkout basement area that had been fully finished by the Contractor who owned the property and who was Selling it …but there were NO permits for the work that had been performed (and hence no inspections and sign-offs by the City/County). There was also a lack of clarity about the actual official livable square footage for the home.
We explained the potential risks to our Client, what the best case outcome might look like, and what the worst case outcome might look like. We shared what cases we have seen in the past, and what the outcomes of those situations were. Our Client thought about it, realized that they did not want to take on the risks of the unknown (along with the hassles that would come with discovering construction defects at a later date) and then made the difficult decision to exercise their contingency option to withdraw from the contract.
